This is way off topic, but... Actually, the legality
of bootleg recordings is very much a gray area and
changes from state to state. Often it is driven by
the venue in which the show is taking place. At least
this is the case with music concerts but I'm assuming
it is the same for a comedy performance. In any case,
what is certain is that it is illegal to make a
recording and then distribute it for profit. Making a
recording for personal use isn't necessarily illegal
(and sometimes encouraged by the performing artist.)
Trading the recordings for other recordings (bootleg
trading) is even a little more gray because you aren't
technically profiting but you are distributing.

I'm going even further off-topic: Tony Levin (www.tonylevin.com) not only
allows for taping his concerts, but once even asked for a tape taken
during a concert when their own equipment broke down...
(http://www.tonylevin.com/bndiary2.htm - "Day 0").
